The Service does not hold ownership or manufacturing authority over any products showcased on its platform, merely serving as a forum for transaction facilitation.

Responsibility of Sellers

Sellers, inclusive of both home cooks and restaurants, bear the onus of strict compliance with all pertinent laws and regulations governing food safety and quality. For restaurants, this entails the maintenance of requisite licenses, permits, and certifications as mandated by local health authorities.

All Sellers are mandated to meticulously delineate their products, including comprehensive information regarding ingredients, allergens, nutritional data, and any other pertinent details. Sellers must ensure conformity with all packaging and labeling requisites stipulated by law.

While home cooks are primarily accountable for the safety and quality of their homemade food products, restaurants are equally obligated to adhere to industry standards and best practices to safeguard the integrity of the food they proffer.

Responsibility of Buyers

Buyers bear the responsibility of ensuring legal eligibility for the procurement and consumption of products facilitated through our platform. Acknowledgment of inherent risks associated with purchasing said products is implicit. Buyers are tasked with perusing and comprehending all information proffered by the Seller, encompassing but not limited to ingredient compositions, allergen data, nutritional insights, and any other legally mandated disclosures.

Limitation of Liability

Kitchen Hopping operates solely as a platform, providing tools and services for the facilitation of transactions between Sellers, Buyers, restaurants, home cooks, and any parties involved in the sale of homemade food products. We are not a party to any transactions conducted through the platform and do not have control over the quality, safety, legality, or accuracy of the products or services offered by Sellers.

Kitchen Hopping, along with its directors, employees, partners, agents, suppliers, and affiliates, disclaims all liability for indirect, incidental, special, consequential, or punitive damages, encompassing but not limited to loss of profits, data, use, goodwill, or other intangible losses. This indemnification extends to instances including access or inability to access the Service, conduct of third parties, content sourced from the Service, and unauthorized access, use, or alteration of user transmissions or content.

Users acknowledge and agree that Kitchen Hopping is not responsible for any aspect of the products or services listed on the platform. We do not manufacture, inspect, or control the products, nor do we guarantee the accuracy, reliability, or suitability of any information provided by Sellers. Any transactions or interactions between Sellers and Buyers are conducted entirely at their own risk.

Indemnification

Users pledge to indemnify, defend, and hold harmless Kitchen Hopping, its licensees, licensors, employees, contractors, agents, officers, and directors from all claims, damages, obligations, losses, liabilities, costs, or debts, including attorney fees, arising from user access or utilization of the Service, breach of these Terms of Service, or content posted on the Service.

Additional Terms

• Kitchen Hopping reserves the right to expunge any listings contravening these Terms of Service and take requisite action against the infringing Seller.
• The platform retains the prerogative to alter or amend the fees or commissions levied on Sellers for platform utilization at its discretion.
• Disputes arising between Buyers and Sellers are to be resolved exclusively between the concerned parties, absolving Kitchen Hopping of any liability.
• Kitchen Hopping bears no responsibility for the quality of food or services rendered by Sellers.
• Any delays or issues occurring during food pickup or delivery are beyond the purview of Kitchen Hopping's responsibility.
• By utilizing Kitchen Hopping, users unequivocally acknowledge comprehension and acceptance of these Terms of Service, assuming the associated risks and responsibilities inherent in purchasing and vending food via this platform.

Changes to the Service

Kitchen Hopping reserves the prerogative to effect changes to the Service sans prior notice. The platform disavows liability in the event of Service unavailability, whether partial or complete, at any given time or for any duration. Access restrictions may be imposed on certain segments of the Service, or the Service in its entirety, intermittently or otherwise, including to registered users.

User Responsibilities

Users are responsible for maintaining the confidentiality of their account information and for all activities that occur under their account. Users agree to comply with all applicable laws and regulations in connection with their use of the Service.
